From 1 July 2026, Australia’s AML/CTF laws expand to cover thousands of SME businesses for the first time. Whether you are captured depends entirely on what services you provide, not your profession.
Please indicate whether your business provides any of the following designated services.
1. Conveyancing
Acting for buyers or sellers, preparing or reviewing contracts, managing settlement, or holding/disbursing trust account funds.
2. Company or Trust Formation
Creating companies, creating trusts, drafting trust deeds, or establishing corporate trustees.
3. Acting as or Arranging a Director, Trustee, or Nominee Shareholder
Providing control roles or arranging control roles for clients.
4. Providing a Registered Office Address
Allowing clients to use your office as their ASIC registered address.
5. Estate Administration Involving Asset Transfers
Selling estate assets, distributing proceeds, or transferring property.
6. Managing Client Property in Connection with a Transaction
Holding or controlling assets as part of a transaction.
7. Assisting with Equity or Debt Financing
Loan application assistance, mortgage documentation, or refinancing support.
8. Corporate Restructuring Involving Asset Transfers
Share transfers, business acquisitions, or asset transfers.
9. Trust Account Activities Connected to a Transaction
Receiving, holding, or disbursing client money.
